HUNTER LIABILITY AND INDEMNIFICATION AGREEMENT
MR \ MRS - _____________________________ (hereinafter referred to as Hunter) Hunter has been given permission to come upon the property located at 7763 COUNTY ROAD 204, ANNAPOLIS MISSOURI 63620 ( TOWNSHIP 33N RANGE 2E NORTH PART LESTERVILLE ) - ( hereinafter referred to as owner's premises ) operated by DAVID \ KELLY SOMMERHAUSER ( hereinafter referred to as " OWNER " )
Hunter acknowledges and understands that no warranty, either expressed or implied, is made by the Owner as to the condition of the Owners Premises. This document is to warn Hunters that dangerous conditions, risks and hazards do exist on the Owners premises. Hunter acknowledges that hunting and other activities on rural property such as the Owner's premises does have unknown risk and hazards and can result in injury or property damage to the person / persons involved in thes activities. The many possibilities and sources of injury or damage are acknowledged by Hunter, and he / she comes on the Owner's Premises with full knowledge that hazards and risk exist.
As a part of consideration for being allowed by Owner to enjoy hunting activities on the Owner's premises, HUNTER HEREBY INDEMNIFIES ( RELEASES ) OWNER from all liability for personal injury ( including wrongful death ) or property damage suffered by Hunter which is caused , in whole or in part, by any activity or condition on the Owner's property. Hunter understands this agreement and has agreed that neither he / she, nor his heirss or personal representatives will be able to sue Owner or his associates for any injury or property damage that Hunter suffers while on the Owners premises. HUNTER INDEMNIFIES AND RELEASES OWNER FROM ALL LIABILITY. As used in this release agreement, the term Hunter / Hunters will include any minors in the Hunters care while on the Owners premises. All Hunters who bring minors understand that the Owner is not responsible for the care or safety of minors.
Hunters who bring minors onto the Owner's property assumes the responsibility for watching and caring for the minors safety and guarding against hazards at all times.
Hunting rights are given to hunt on above listed property ( 96 ) acres for game listed below. All permits ( except for feral hogs, which may be taken in any number, under any method - day or night ) will be the responsibility of the above mentioned Hunter. During your hunt, the above mentioned hunter may also take COYOTE'S when in season, with a valid reg hunting permit. Camping on property is permitted with prior approval. During your hunt, you are asked to treat property as if it were your's. Pick up and REMOVE all your trash, respect all wildlife codes and restrictions and obey all local and state laws ( or your party will be asked to leave premises ) . All gates on property must remain closed at all times. Trucks and 4 wheelers are premitted for Hunter's , we ask that you use caution and remember state laws prohibit 4 wheeler use in creeks / streams. During the above mentioned hunt, only your party will be on property. No other parties will be will be booked with your group. Although we try to make sure your hunt is successful, we do NOT guarentee a harvast of any kind. We do offer a 50 % discounted return hunt to any hunter on a 60 hour weekday or weekend hunt package that does not harvast a feral hog ( this offer is not valid on 36 hour hunts ) . The 50 % ( half price ) hunt must be used for WEEKDAY only ( not valid for weekends ) Note - any hunter bringing a child as part of our TAKE A CHILD HUNTING PROGRAM ( for children 16 and younger with a paid adult ) that chooses to let the free child hunter harvast over them will not be allowed a return 50 % off hunt - the harvast of the free child hunter counts as your harvast . During hog hunts, bait ( corn mix ) is placed in feeder area's around stands - there are several ( safe ) stands on property for Hunters use or the above mentioned hunter may bring his own. No pop up style ground blinds will be allowed for hog hunting. We recommend all Hunter's use a high powered rifle and hunt from a tree stand. As with any hunt, plan for your hunt - FERAL HOGS ARE MOSTLY A NOCTURNAL ANIMAL - THIS MEANS YOU MUST BE READY TO HUNT AT NIGHT - REMEMBER IT IS BETTER TO HAVE IT AND NOT NEED IT , THEN NEED IT AND NOT HAVE IT.
